How do you avoid inexperienced clinical negligence lawyers?

This week, the Law Society Gazette has highlighted concerns that inexperienced personal injury law firms may be attempting to move into the specialist area of clinical negligence claims.  

The Gazette reports that insurers have noted a surge in firms seeking ‘after the event’ insurance which are often essential in running a medical negligence claim. A representative from one insurer told the Gazette that he had observed a trend of firms who did not have a history of case statistics, and firms which had only been working on clinical negligence claims for a short period – as little as six to nine months.

If you are thinking of bringing a claim for medical negligence, you may find it difficult to know which law firm to choose. There are many firms claiming to offer expert advice, but how can you distinguish the true specialist clinical negligence lawyers from the rest?

Accreditations

Specialist clinical negligence solicitors are often accredited by professional bodies. The two main accrediting bodies for clinical negligence lawyers are the Law Society’s Clinical Negligence Accreditation Scheme, and the patients’ charity, Action against Medical Accidents (AvMA). Clinical negligence law is a part of personal injury law, so you may also come across solicitors who are litigators, senior litigators or fellows of the Association of Personal Injury Lawyers (APIL). Membership of APIL is not a guarantee that a solicitor is a clinical negligence specialist – they may practice primarily in a different area of personal injury law.

Don’t be afraid to ask questions!

If you are going to instruct a solicitor it is important that you feel confident in their ability to assist you with your claim. Clinical negligence lawyers need to have extensive medico-legal knowledge, and many have expertise in particular types of claims. Ask your lawyer about their experience with claims like yours.

Ask for recommendations

Remember, clinical negligence claims can take some time to bring to a conclusion, so you should expect your lawyer to have several years’ experience at least. Whilst clinical negligence is part of personal injury law, it requires specialist medico-legal knowledge and the best clinical negligence lawyers are often the most experienced.
